Tony is an insolvency and corporate recovery specialist. In addition to being a solicitor, he is a Licensed Insolvency Practitioner, authorised by the Insolvency Practitioners Association, and a Solicitor Advocate (civil). He receives instructions from Insolvency Practitioners ranging from Magic Circle firms to sole practitioners. Those instructions may be of a procedural, professional or technical nature, while the sources of his other instructions include banks, creditors (secured or otherwise) and directors.

Tony lectures extensively and has lectured for Central Law Training, R3, and Legal Easel. He particularly enjoys in-house tailor-made seminars for clients. Tony is also involved with the Joint Insolvency Examination Board.

 

Expertise

Tony advises insolvency practitioners, creditors and directors on all formal insolvency procedures, including administrations, receiverships, voluntary arrangements and liquidations, with experience across both corporate and personal insolvency matters.

Experience

  • Advised on appropriate insolvency procedures
  • Advised on Voluntary Arrangements and Trust issues
  • Advised on pre-pack sales in Administration and SIP 16
  • Advised on trading on by a multi-sited retail company in administration
  • Advised on obtaining overseas bankruptcies

Tony represents stakeholders in director disputes, disqualification proceedings and creditor claims, with additional experience in trust-related insolvency issues and high-value claims arising from alleged misconduct or mismanagement.

Experience

  • Pursued directors for breaches of their fiduciary duties under the Insolvency legislation and Companies Act 2006
  • Defended trust claims in bankruptcies
  • Advised on priority of debts and expenses (including office-holders’ expenses) in insolvency proceedings
  • Pursued directors for unlawful redemption of preferential shares
  • Advised on “Barclay Applegate” orders
  • Advised on COMI and attacking jurisdictional “forum shopping”
