Aman is a restructuring and insolvency lawyer with more than 20 years’ experience working on high-profile corporate and personal insolvency cases that include multi-million pound bankruptcies and fraud investigations. With expertise that covers dealing with contingency planning, insolvency filing requirements, debt restructuring, financing and acquisitions/sales, g, formal insolvency proceedings, restructurings, refinancings, and debt trading, his career has seen him advise an array of insolvency practitioners on various complex matters.

Aman has significant experience in acting on behalf of directors in all aspects of directors’ disqualification proceedings, including defending proceedings and seeking application for leave to remain. Aman also acts for directors and companies in relation to company restoration and “bona vacantia” claims.

Expertise

Aman advises insolvency practitioners and directors on administration, company restructures and refinancing, CVAs, IVAs, liquidations (including public interest and provisional appointments), personal bankruptcy, receivership, fraud investigations, and recovery claims.

Experience

  • Acting on behalf of high-profile trustees in bankruptcy in relation to both UK-based and international asset tracing and enforcement.
  • Acting on behalf of insolvency practitioners and HM Revenue and Customs in relation to asset recovery work investigating antecedent and fraudulent transactions, representing clients in both the High Court and County Courts.
  • Provided advice on various corporate and restructuring aspects to an energy company in relation to external investments, a share restructure and new arrangements with shareholders and a new joint venture vehicle.
  • Acting in conjunction with The Insolvency Service in relation to the investigation of live companies and multi-million pound frauds including “land banking” and “carbon credit” frauds.
  • Advised a multi-site pub chain on their insolvency options in advance of a pre-pack administration to include liaising with the appointment of a suitable insolvency practitioner.
  • Advised a Michelin-starred chef and restaurateur in respect of his personal liabilities as a director of a hospitality business on the verge of insolvency and minimising his risk and personal liabilities for wrongful trading.
  • Provided insolvency and restructuring advice to a private members’ club in London.
  • Acted on behalf of a chain of restaurants and delis in administration, including advising upon and completing an asset purchase from the administrators to allow for the business to be restructured and reopen post-Covid.
  • Acted on behalf of a boutique Northern Irish hotel in respect of the administration of its gym tenant and provided insolvency advice in respect of the proposed licence to assign and continuation of business by the incoming purchaser.
  • Acted on behalf of a multi-site co-working business in relation to is sale through an administration process.
  • Acted on behalf of a number of directors in successfully defending directors disqualification proceedings where allegations included bounce back loan fraud and trading to the detriment of HMRC.
  • Acted on behalf of a number of directors in successfully obtaining permission for leave to remain as a director pursuant to s.17 CDDA 1986.
  • Acted on behalf of a university successfully rescinding a winding up order and dismissing a winding up petition.

Aman advises on company restructures and refinancing, and corporate governance, including directors’ duties and disqualification.

Experience

  • Advising in the role of company secretary for a property group in Newcastle which owns and operates 15 care homes.
  • Provided advice on various corporate and restructuring aspects to an energy company in relation to external investments, a share restructure, and new arrangements with shareholders and a new joint venture vehicle.
  • Worked closely in an advisory capacity with regulatory bodies such as the Office of Fair Trading, the Financial Conduct Authority, and The Vehicle and Operator Services Agency, including advice on ongoing investigations and proposed litigation.

Aman advises clients across the hotels, hospitality and leisure sector on insolvency, restructuring, refinancing, and debt trading.
