Shinead is a property expert with over 15 years’ experience advising developers, landowners, investors, and commercial and individual owner-occupiers and tenants. She specialises in rights of light matters but has broad experience across a full range of neighbourly matters, including boundary disputes, party wall issues, adverse possession, rights of way, and noise nuisance, acting on both contentious and non-contentious matters. She is also an expert in dealing with transactional property matters including acquisitions, sales, and high-value refinancing.

Shinead is primarily recognised for her expertise in property-related disputes, particularly rights of light disputes.

Her clients include national and regional developers, institutional investors, high-net-worth landowners, and major commercial occupiers.

Shinead is experienced in negotiating and incepting high-value rights of light insurance policies and dealing with rights of light claims that are insured.

  • Settling multiple rights of light policies in respect of major developers’ schemes of development.

Shinead has over 15 years’ experience in dealing with high-value commercial and residential property sales and purchases and multi-million-pound refinances.

  • Bespoke advice in respect of acquisitions and sales from a right of light risk perspective.

Shinead advises on all aspects of rights of light and neighbourly matters, guiding developers and landowners through risk mitigation, negotiation, and dispute resolution.

Experience

  • Advised a major hotelier on defending injunctive proceedings relating to a rights of light and trespass claim and successfully resolved the dispute to allow the consented development to proceed.
  • Advising in respect of various easement claims pursuant to the Prescription Act 1832.
  • Advising in respect of strategy in respect of various light obstruction notices and claims under the Rights of Light Act 1959.
  • Advised a major developer in respect of co-existing restrictive covenant and rights of light issues that burdened the developer’s site.

Shinead advises various established clients and lenders in respect of high-value refinances.

Experience

  • Acting for various lenders, property portfolios, and investment managers in respect of rights of light considerations.
  • Acting for lenders in respect of high-value loan-to-ratio transactions for existing residential portfolio clients.
  • Undertaking specialist due diligence for the client/lender in respect of rights of light and neighbourly matters risks that may arise in sales/purchases.

Shinead advises on complex property disputes and issues involving boundaries, easements, adverse possession, and nuisance.

Experience

  • Successful in securing a final injunction for a developer client, Pencross Assets Limited, in respect of its King’s Cross commercial property following the unlawful notifiable works undertaken by the neighbouring owner which resulted in the partial collapse of its building. The client was successful in recouping 100% of its costs.
  • Acted for a claimant pension fund in respect of a litigated rights of light claim that was successfully settled.
  • Advised a developer client in respect of its City of London development and its rights of light mitigation strategy.
  • Acted on multiple light obstruction notice applications pursuant to the Rights of Light Act 1959, both in respect of emergency and non-emergency applications to the Upper Tribunal.
