Martin is a Partner in the Dispute Resolution team, with a wide-ranging practice which includes general commercial litigation and property litigation. He has more than 30 years of experience at all levels of the court system, and is also very familiar with alternative dispute resolution methods such as mediation.

His commercial litigation practice includes all types of contractual disputes, debt collection, directors’ duties and fraud, as well as matters relating to joint ventures, partnerships, and shareholders.

Martin’s expertise in property-related matters includes all disputes involving landlords and tenants of both commercial and residential properties, as well as adverse possession, boundaries, rights of way, restrictive covenants, rights of light, and other easements. He also has experience of planning and building disputes and negligence claims concerning professionals in the property sector.

With a flexible approach to funding, Martin has operated under conditional and contingent fee agreements, as well as actions funded by legal expense insurance and third parties.

Experience

  • Coordinated debt collection strategies for companies and sensitive service providers, including care homes, private schools, and estate agents.
  • Acted in the enforcement of a loan agreement in respect of a luxury motor yacht business.
  • Acted in the successful pursuit of damages arising from an art fraud in several foreign jurisdictions.
  • Advised on numerous commercial contract disputes across a wide range of industries and sectors, including banking, built environment, fashion, film & TV, fine art, fitness, football, healthcare, and publishing,

Martin advises on a very wide range of property-related disputes including landlord and tenant disputes, as well as the varied rights and obligations associated with land, such as adverse possession, boundaries, rights of way, restrictive covenants, rights of light, and other easements.

Experience

  • Advised on a contested lease renewal of a Central London restaurant premises.
  • Advised on protecting the property interests of a London restaurant chain.
  • Successfully enforced an agreement for lease, including in the Court of Appeal.
  • Acted in a disputed joint venture in respect of a valuable Central London commercial property.
  • Acted for the landlord of a large London apartment complex.
  • Acted for tenant groups in dispute with their landlords.

Martin has significant experience of assisting clients to achieve favourable outcomes through ADR, in particular mediation.

Experience

  • Secured favourable settlements for numerous clients at mediation.
  • Worked as a mediation co-ordinator for a major ADR provider.
  • Obtained accreditation as a mediator, and has experienced the process as a mediator, as an advisor, and as a client.

Martin advises on civil fraud claims, including high-profile art and commercial cases.

Experience

  • Acted in a high-profile fraud claim in connection with a modern art collection.
  • Acted in an art fraud case that involved obtaining and then successfully enforcing judgment for damages in a number of foreign jurisdictions.
  • Acted in a long-running case concerned with the alleged obtaining of a judgment by fraudulent means.
