Robert is a highly experienced commercial disputes lawyer with broad-ranging experience in resolving complex and multi-layered disputes.

As a seasoned litigator, Robert has extensive expertise in all forms of dispute resolution, including mediation, arbitration, and adjudication with the aim of settling before court litigation. When litigation is required, he regularly handles cases before the courts, including those involving worldwide freezing injunctions in high-value disputes.

In addition to advising clients across a wide range of commercial disputes, Robert has specialist knowledge and experience in relation to intellectual property and disputes affecting shareholders and company boards. His expertise in intellectual property disputes includes High Court litigation and wider advice relating to design rights, trade marks, copyright, database rights, passing off and patents.

Robert also has specialist knowledge and experience of construction disputes, including advising on high-value adjudications.

Experience

  • Advised on high-value, cross-border proceedings relating to EU and UK design rights and patents in an innovative commercial barrier system widely used in international airports, factories and warehouses.
  • Advised on a trade mark and board-level dispute for a London fashion label involving a broad range of actions, including breach of fiduciary duty, defamation, passing off, and trade mark infringement.
  • Advised on a trade mark infringement dispute involving an internationally operating food delivery service and Asia-based new market entrant manufacturer of a design-led electric scooter.
  • Advised insolvency practitioners and successfully defended long-running, multi-claim High Court proceedings claiming trade mark and copyright infringement over all intellectual property rights in an online dating platform.
  • Advised on allegations of breach of contract by two individuals claiming an interest in a highly successful dating app.
  • Successfully defended and settled claims by a global independent music publisher regarding copyright and royalties in a broad array of music titles mainly, centred around the work of a multi-platinum sales and Grammy award-winning music producer.
  • Provided strategic intellectual property advice to an India-based manufacturer of smart phones regarding Standard Essential Patents (SEPs) for smart phone technology.
  • Resolved numerous disputes for a book publisher involving allegations of copyright infringement by other publishers and authors.
  • Advised the founders of a UK-based not-for-profit company working to advance sustainable carbon removal on a range of intellectual property and start-up issues.
  • Provided long-standing and wide-ranging intellectual property advice to a UK consultancy focussed on next-generation modelling to understand and navigate future uncertainty and consultancy on net zero dynamics and technologies.
  • Advised on a design rights dispute relating to contemporary office furniture products.

Robert acts on complex and high-stakes shareholder disputes, including boardroom fallouts, director misconduct, misuse of company funds, and cross-border litigation involving closely held and multinational companies.

Experience

  • Successfully represented the board of a global marketing business, in High Court litigation following disputes arising from an acrimonious split between the shareholders, with proceedings taking place in the UK, Canada, Germany and Dubai.
  • Successfully defended High Court proceedings brought by one shareholder against the directors of numerous IT companies resulting in the vast majority of the claims being struck out.
  • Advised the majority of shareholders of a London-based property investment company on a dispute whereby minority shareholders were controlling activities through the unauthorised actions of a single director. Mechanisms in the company’s articles of association were used to take back control and ultimately force a settlement.
  • Acted in a bitter dispute between two equal shareholders of a series of property development companies. Identified accounting anomalies over a 10-year period through forensic accounting and extensive negotiation to obtain wide disclosure.
  • Advised one of two equal shareholders and directors in a recruitment consultancy regarding misappropriation of company funds by the other director and shareholder.

Robert advises on complex construction disputes, including adjudications involving delay, payment claims, and insolvency issues under JCT contracts, often requiring expert evidence and rapid analysis of technical documentation.

Experience

  • Acted in an adjudication in respect of issues arising from the delay in construction with a multimillion-pound renovation of a super-prime house in Knightsbridge with input required from numerous expert witnesses including on delay and quantum.
  • Acted for Insolvency Practitioners in respect of claims for companies in administration focussing on claiming sums due under the insolvency provisions of JCT contracts and included adjudications against some opponents.
  • Responded to a £1.5million ‘smash and grab’ adjudication concerning a JCT design and build contract which required an extremely fast and complex analysis of a large amount of documentation concerning around 15 separate applications for payment made during a period of over a year. 95% of the sums claimed were dismissed.

Robert advises clients in the telecoms and telecommunications sector on intellectual property, breach of contract claims, director and shareholder disputes, and construction litigation.
