Andrew has over 30 years’ experience as a litigator who has acted in all types of property disputes. This has extended to professional negligence claims against solicitors, architects, and other building professionals, and insolvency disputes with a property aspect.

Andrew also has extensive expertise in both non-contentious and contentious planning work.

Andrew has contentious and non-contentious expertise in outdoor advertising where he acts for national operators.

Andrew also has expertise in club disputes and the dismissal of members.

Andrew’s clients include multinationals, public companies, high-net-worth individuals, property and leisure companies, property developers, landowners, and clubs.

Expertise

Andrew advises clients on issues involving leases, including service charge and dilapidations claims, and conflicts relating to easements, boundaries, and land ownership.

Experience

  • Acted for a tenant in connection with its liability to repair a Reinforced Aerated Autoclave Concrete Roof.
  • Acted for a landlord in enforcing its claim for breach of nuisance covenants contained in the lease.
  • Acted for landowner in a claim to rights to light.
  • Acting for landlords and tenants in their claims to enfranchise leases.
  • Acted for a landowner in a dispute regarding a boundary feature and the extent of a right of way.
  • Acted for a landowner in a claim for compensation under the Highways Act 1980.

Andrew advises on planning law across both contentious appeals and advisory work, assisting developers, landowners, and public bodies with planning applications, enforcement notices, objections, and long-term land-use strategies.

Experience

  • Advised two leisure resorts in the Cotswolds Lakes in connection with planning matters.
  • Advised advertising companies on a local authority’s entitlement to terminate advertising rights.
  • Provided planning advice to private individuals in relation to the liability for Community Infrastructure Levy.
  • Drafting s106 agreements and undertakings on behalf of property owners.

Andrew advises on professional negligence actions, acting for clients pursuing claims against surveyors, lawyers, and engineers and insolvency claims with an insolvency aspect.

Experience

  • Acted for a property owner in a dispute with Law of Property Act Receivers about the actions that the Receivers could take.
  • Acted for a freeholder in its disposal of property in the context of insolvency.
  • Acted for a property owner in a claim for negligence against his solicitor.

Andrew advises companies and individuals on both the contentious and non-contentious aspects of advertising agreements and the entitlement to advertise on land.

Experience

  • Advised a national advertising panel owner on property issues arising across its national portfolio.
  • Advised an owner of a portfolio of advertising panels in its disposal to a national portfolio site owner.
  • Advised a landowner in connection with property and planning issues at a site overlooking the Chiswick Flyover.
  • Advised advertising companies on the terms of their agreements.

Andrew advises clubs and individuals in connection with membership rights.

  • Advised a member on the lawfulness of the member’s expulsion.
  • Advised a club on the procedures required to change the club rules.

With experience in the outdoor advertising industry, Andrew supports media companies and landowners on matters involving billboard leases, planning permissions, and regulatory compliance unique to out-of-home advertising environments.

Experience

  • Acted for a leading outdoor media company on the grant of leases of advertising sites and the effect of lease terms on advertising panels throughout England.
  • Acted for a portfolio owner in the disposal of a portfolio of advertising panels.
  • Advised a panel owner in connection with whether there was deemed planning consent.
  • Acted for a panel owner in an appeal against a removal notice.
  • Provided advice in connection with a discontinuance notice.
  • Provided advice on the terms of advertising licences both on freestanding sites, on the side of buildings, and on scaffolding whilst buildings are being refurbished.
