Emma is an employment partner, with extensive experience advising clients on all employment law and human resources-related matters, such as performance management and discipline issues, grievances, restructures, holiday entitlement and holiday pay, and defending claims in the Employment Tribunal.

As well as employment law, Emma also has a strong background in data protection and privacy, advising clients on a range of issues relating to privacy and data protection law, including policies and legislative compliance, data subject rights, and data breaches.

Emma regularly delivers training sessions on a variety of both data protection and employment and HR matters, covering topics such as sexual harassment, discipline and grievance processes, and equality and diversity.

Expertise

Emma advises employers and employees on all aspects of employment law, including restructures, redundancies, TUPE, performance and disciplinary matters, grievances, discrimination, unfair dismissal, whistleblowing, restrictive covenants, pay, benefits, and Employment Tribunal claims.

Experience

  • Advised a financial services provider in relation to allegations of sexual harassment against a senior employee, including assisting with the disciplinary process and investigation.
  • Advised a charity client in relation to TUPE.
  • Assisted an online retailer in defending an Employment Tribunal claim involving claims for discrimination and unfair dismissal.
  • Provided support to a public sector client in relation to a grievance raised by a senior and long-serving employee.
  • Advised a logistics company in relation to an employee’s long-term sickness, and the management of this.
  • Advised a charity in relation to the grievances raised by an employee and subsequent disciplinary action required.
  • Advised on HR and employment-related policies, including updating existing policies as well as writing new policies for a large not-for-profit organisation.
  • Advised a construction client on various employment-related issues, including performance management and disciplinary issues.
  • Assisted a charity client in negotiating the exits of a number employees and office holders, including preparation of settlement agreements and negotiating their terms.
  • Defended an international client against claims for discrimination in the Employment Tribunal, and successfully concluded settlement negotiations.
  • Advised a senior executive in relation to their ongoing employment with their employer, negotiating their exit, and advising on settlement terms.

Emma advises on all aspects of data protection, including compliance, impact assessments, contracts, international transfers, privacy policies, data breaches, subject access requests, employee monitoring, screening checks, and implementation of CCTV systems.

Experience

  • Advised an international retail client in relation to all aspects of its data protection compliance, including in relation to its new projects, assisting with the completion of data protection impact assessments, reviewing the data protection provisions in the contracts, meeting with vendors, and advising in relation to potential issues and next steps.
  • Advised a regional financial services client in relation to its website privacy and cookie policy and assisted that client with a complaint in relation to their use of cookies.
  • Advised an international client in relation to a number of data breaches, including assessing the issues and reporting the breaches to the ICO.
  • Advised a construction client on employee monitoring and use of CCTV.
  • Advised a financial services client in relation to carrying out background screening checks (including in relation to criminal convictions).
  • Acted as data protection officer for clients in different sectors, including a large international money exchange client, and a company carrying out research in life sciences, supporting its growth from a startup, through its funding cycles and eventual sale.
